Terms and conditions

Definitions

The "Seller" or "ALLO3D" means the company ALLO3D EODD established in Bulgaria and entered in the registry of business companies at Varna district court under corporate Bulstat n°200265495 and

"The Client" or the « Buyer » or the « Costumer » means any person or entity using and /or buying one of the services provided by Allo3D or on the site ALLO3D.com

1. PURPOSE OF CONTRACT - BENEFITS OF THE COMPANY ALLO3D

The present contract is about selling services as 3d visualizations, animations, websites and/or marketing materials by the seller and for the client, in order to promote or illustrate architectural projects .

2. TERMS OF ORDER.

2.1
Command conditions are accessible online from one of the seller's website (allo3d.com, allo3d.fr, allo3d.es, allo3d.co.uk, 3dlowcost.co.uk, 3dlowcost.com).

2.2
To purchase 3d visualizations for domestics houses, the customer agrees to provide the following technical materials exclusively at the command line:
- a 2D scanned paper plan sufficiently detailed with a sufficient resolution in the form of a computer file format and with the extension .jpg

or a 2D detailled plan in a computer file format with the extension .dwg ( "autocad" ® format)
If the customer has a file in another format, it will have to conduct « export to » using one of its software in order to get a .dwg file.

- The choice of one or more angles of views (each angle chosen will lead to a different image). The accuracy of the angle is given by the customer for information and ALLO3D not be held liable for slight modification of that angle. No appeal may be initiated against the company ALLO3D in this case.
- The choice of an architectural project style with a predefined style, a style given by the customer (in the form of a computer file format with the extension .jpg) and / or a possible text description
- If applicable, a photography (in the form of a computer file format with the extension .jpg) forintegrationinto real site.

2.3
To purchase any other service, the customer agrees to provide the technical elements agreed between the parties.

2.4
The attention of the customer is drawn to the fact that the technical elements as indicated under article 3.2 and 3.3 shall be provided to ALLO3D with a sufficient quality and conform to technical requirements of manufacturers to ensure quality work . If the conditions above are not collected, ALLO3D reserves the right to refuse outright execution of the order for a "just cause", particularly in case of inability to perform the service.
Thus, the customer agrees to guarantee the present society ALLO3D for all the consequences of an action stems from the failure, lack of quality, or bad use of technical elements provided by the client himself.

In addition, the company ALLO3D reserves the right to refuse outright execution of the order for a "just cause" as abuse of customer demand, as presumption it is impossible for the client to enter the order and in case of clear intention for the client to harm the company. In such a case, all sums already paid remains to Allo3D.
The company also reserves the right to refuse the order in the case of an obvious typographical error leading to the appearance of a "small price", particularly when the order placed online by the customer on the website www.allo3d.com, for reasons of system failure or for any other reason, as misuse of the system. In such a case, an email warning would be sent to the client when processing the command to prevent it as soon as possible.

2.5
Each command will be validated by a full payment or a deposit:
- Either directly online from the website www.allo3d.com
- Either on receipt of payment by bank transfer.
An online order is validated when the customer provides payment by clicking the buy button. Clicking on the buy button, the command is firm and definitive, its performance is automatically processed and are deemed to have begun.
Under the special online domestics houses service, orders will be processed and validated exclusively online from the website www.allo3d.com.
Once payment is made successfully, the customer will receive an email confirmation, invoice and a password allowing access to secure customer account. The latter can see the order status.
For all orders validated, Allo3D ensure to provide the service to the client and to respect the deadline. For all orders validated, the client is deemed to accept these terms and conditions.
Order confirmations will be archived on the server of the Seller and will be considered as proof of the nature of this Convention and its date.

3. METHOD OF PAYMENT.

3.1 GENERAL
Payment for services provided by the seller is by bank transfer or by credit card via the website www.allo3d.com.

Under the special online domestics houses service, payment will be fully and exclusively online, from the website www.allo3d.com. In addition, prices for this service are exclusively related to an online order.

For other projects, payment is usually made in full prior to delivery or in two parts, a 50% deposit before starting the service and 50% after the completion of the service.

The prices are freely determined by the Seller and may change at any time without notice.

If you pay with another currency exchange costs are borne by the customer.

3.2 ONLINE PAYMENT
For all online payments, once the order has been validated by pressing the button "buy", it shall be deemed commenced and any amount paid shall be deemed granted.
However, if the impossibility of implementing the service, for whatever reason, Allo3D agrees to return the entire payment to the account previously charged.
For all online transactions, the bank only accepts payments in BGN (Bulgarian lev). Since January 1999 the official rate of exchange is € 1 = 1.95583 BGN.

To ensure maximum security during transactions, ALLO3D selected the services of the bank Unicredit Bulbank, a subsidiary of the largest Italian bank Unicredit, which is present throughout Europe.
Transactions are made with a maximum level of security with the "Verified by Visa" for Visa International and Secure Code "for MasterCard International. The transactions are secure with proven technologies, including means of encryption SSL (Secure Socket Layer).

Before the payment of the order, it is clearly stated the price to pay VAT (VAT is not recoverable).

3.3 PAYMENT BY BANK TRANSFER

The customer can make payment by bank transfer in Euros, all the transfer fees are charged to the customer, on the following account:

Once the order is validated and the payment made, it shall be deemed commenced and any amount paid shall be deemed granted.

4. DELIVERY TIME - METHOD OF WORK - AFTER SALE SERVICE.

4.1 TIMETABLE
ALLO3D undertakes to implement all means at its disposal to ensure timely delivery faster.
The deadlines vary depending on the service provided. A longer period may be necessary depending on the complexity of the services ordered. Our times are indicative, being exceeded, this will in no circumstances give rise to claims for damages or the agreement of any compensation or refusal, unless otherwise specified when ordering.
In the latter case, ALLO3D not be held responsible for the longer work inherent to a delay validation or data communication from the customer.

4.2 QUALITY
ALLO3D ensures the best rate between quality and price on his performance. However, the customer is informed that benefits an extremely efficient quality can be achieved by a service in connection with the asking price. Thus, for the prices, ALLO3D can offer quality services comparable to that outlined in its portfolio without this can be a quality match.

4.3 CHANGES

4.3.1 GENERAL
ALLO3D reserves the right to accept or reject any change in command. In some cases, partial or total change of command can lead to a new order. Any benefit not provided by the order may be a additional order agreed between the parties.

4.3.2 DOMESTICS HOUSES 3D PICTURE ONLINE SERVICE
The deadline for providing images of houses is the average from a few days to a week.
Once the service provided, it is sent to the customer who has the right to request changes to the service. The number of requests for amendments is limited to one request. Such requests can only focus on finishing the picture. It is not possible, as an example, to return to the technical elements provided at the command (as the plan provided, or angles are chosen, the photo integration, ...). Each request shall not be for more than 10 working hours.

4.3.3 OTHER 3D VISUALIZATIONS
The deadline for the delivery of 3Dvisualizations depends mainly on the size of the project. Once the service provided, the result is sent to the customer who has the right to request changes to the service. The number of requests for amendments is limited to two requests. Such requests can only focus on finishing the picture. It is not possible, as an example, to return to the technical elements provided at the command (as the plan provided, or angles are chosen, the photo integration, ...). Each request shall not be for more than 10 working hours.

4.3.4 OTHER BENEFITS
For projects other than those mentioned in Articles 5.3.1 and 5.3.2, the execution of the order is carried out in two phases.
After receiving all the technical elements of work and the first payment (see article 4), ALLO3D undertakes to give the first idea of the service (design for a web site, script for an animation, ...) for validation of this first phase.
After validation, ALLO3D provide the final delivery.
The customer has the right to two changes per order for the first phase and two changes for the second phase. An change can be considered as a request from several small changes without bringing a substantive change of command. Any modification shall not be for more than 10 working hours.
Any further amendment of the order may be subject to additional taxation. The amount of the order and the charges for additional modifications may be ordered and notified by email or fax.

5. RIGHTS OF IMAGES AND CREATIONS.

5.1 CREATIONS PROVIDED TO ALLO3D
As part of the mission entrusted to it, the company ALLO3D will have to work from contributions (plans, drawings and other illustrations) created by designers, architects and other natural or legal persons.
The company ALLO3D has on these contributions no direct right, which shall remain the intellectual property of their (s) author (s). By giving to ALLO3D these elements, the client admits having obtained, whether free, authorization and the full agreement of the copyright holders (s) and related rights of these plans, drawings, other illustrations or photos for use.
More specifically, in the case where the subject of the order need a project integration in an existing site, the client is responsible to protect the rights and permissions to use images and representations on photographies of the site and to enable work to change any of them.

The customer will result in his personal matter in any dispute that may arise with respect to this Article 5.1, so that the company ALLO3D is neither concerned nor sought any way, pledging to ensure to any claim which would be made.

5.2 CREATIONS PROVIDED BY ALLO3D
Before payment complete, any achievement provided by the company ALLO3D remains its artistic and, as such, remains only ALLO3D copyright owner assigned to this achievement.
The payment, once carried out in full, opens to the customer the benefit of the rights of authors under the command he has passed: use, reproduction and exploitation of these images in order to promote or illustrate architectural projects, whether on paper or computer.

Any use of the command other than its intended purpose, any sale or full or partial to others, by the client (eg a "reseller") can be achieved but will require prior written approval of the Company ALLO3D; Then the settlement of copyright will be negotiated and determined on the basis of uses.
Similarly, the customer agrees not to modify the images that were surrendered.

In the framework defined above, the client becomes aware of the rights of the Company ALLO3D to use any service or product provided for its own portfolio or for his book and personal publicity, whether virtual or real.

6. PRIVACY - DATA

6.1 CONSERVATION AND THE ELEMENTS TECHNICAL DATA ARCHIVE.
Once its mission conducted in terms of the order, the technical elements originally supplied by the customer will be destroyed within regular timetable without this may give rise to any compensation or recourse whatsoever.

The company ALLO3D will also retain on DVD, all files production during a period of one year. It can not be held responsible in any capacity whatsoever, unintended damage or theft of these materials.

6.2 CONFIDENTIALITY
The customer agrees not to disclose to third parties and competitors information on know-how and specific means implemented by the company ALLO3D in fulfilling its mission, and he was aware at the time it. Meanwhile, the company ALLO3D will not disclose information that the client has specified as confidential in nature, since they do not prevent the execution of the mission.
6.3 PERSONAL INFORMATION.
For the smooth functioning of the command, the costumer's data collected will be processing with the entire acknowledge of the costumer. These data will not be sold or exchanged for commercial purposes. The Customer has also, through a specific access the right to access and correct with respect to any information concerning the file thus formed. This access will be accessible via password and available, by mail, in case of loss upon request. The information requested upon Client are needed to process the order and may be provided to partners of the company. They may also be sent to any competent authority for settlement of disputes between the company and one of its customers.

7. MAJOR FORCE AND NATURE OF INTERNET NETWORK

A cesa of major force, can free the seller from its obligations towards the Client. This will be the major force that usually qualified by the courts. The malfunction or shutdown of Internet transmission will be considered a major force. The use of the Internet is at own risk and peril of the user. Seller can not provide any guarantee on the availability of service, network performance, servers, etc..

8. ENTIRE AGREEMENT

These terms and conditions reflect the entirety of the obligations of the parties. No general or specific condition provided by the client can integrate with these conditions, except in cases of prior agreement between the parties prior to the conclusion of the contract.
The fact that the company does not rely on a failure by the Customer with any obligations under the present can not be interpreted in the future as a waiver of the obligation in question.
The company reserves the right to modify or to change at any moment these terms and conditions of sale. If changed, it will be applied to each order the general conditions of sale date of the order. The company will also maintain on its servers every time-stamped versions of the general conditions of sale.

9. ALLOCATION OF COURT - SETTLEMENT OF DISPUTES.

For all disputes relating to services provided by ALLO3D and application or interpretation of these terms and conditions, the parties undertake to find an amicable resolution.
In the event no such agreement can be reached the dispute shall be brought before the competent court in the Republic of Bulgaria.
